Recruitment — AI-ready hiring

Irish law lens: Employment Equality Acts 1998–2015, ss.8 & 10 — discriminatory advertising is itself unlawful.

Equality guardrails

  • No reference, direct or by proxy, to any of the nine grounds: gender, civil status, family status, sexual orientation, religion, age, disability, race, membership of the Traveller community.
  • Requirements must be genuine and proportionate to the job — every 'essential' criterion should survive the question 'why?'
  • State that reasonable accommodation is available in the application process.

AI checkpoint — high-risk use

Algorithmically targeted job ads are Annex III high-risk. Keep a targeting log: platforms, audience criteria, exclusions. Age-band or gender-skewed targeting is discriminatory advertising today, before the AI Act even applies.
